Fair Use Policy

1. Introduction

This Fair Use Policy (the “Policy”) outlines the acceptable use of the Services provided by Make Media Limited, trading as MakeUGC ("we", "our", or "us"). Our platform leverages artificial intelligence to generate user-requested video content, including brand stories, avatar-led testimonials, and promotional assets. By accessing or using our Services, you agree to be bound by this Policy, in addition to our Terms of Service, Privacy Policy, and other legal notices.

‍

This Policy is intended to protect the integrity of our services, ensure fair usage across all users, and preserve a high standard of legal and ethical compliance, especially as it relates to intellectual property, licensing, and responsible content generation in AI environments.

2. Order Limitations and Service Allocation

In order to ensure fair access to our Services, particularly during periods of high demand, MakeUGC enforces a single active order policy for certain product categories. Users may place only one video generation request at a time. Once the request is fulfilled and delivered, users are permitted to place a new request.

‍

This approach enables us to maintain production quality, ensure equitable access to our AI agents, and allocate resources responsibly across our global user base. Abuse of this policy through circumvention, multi-accounting, or automation may result in account suspension or termination.

3. Content Submission Responsibilities

Users are solely responsible for the legality, originality, and licensing of all content submitted through MakeUGC’s Services. This includes, but is not limited to:

• Text prompts
• Uploaded assets (logos, images, video references)
• Scripts and voice instructions
• Third-party brand references or likenesses

By submitting content, you warrant that:

• You own the intellectual property rights to the content, or
• You have obtained proper licenses, permissions, or consents to use such content.

MakeUGC retains the right to review, reject, or request modifications to any submitted material that violates copyright law, regulatory standards, or our platform policies.

4. Prohibited Content and Activities

MakeUGC strictly prohibits the use of its Services for the creation, distribution, or facilitation of the following:

• Pornographic, sexually explicit, or adult content
• Violence, hate speech, or discriminatory material
• Content promoting illegal drugs, substances, or activities
• Fraudulent, deceptive, or misleading advertising
• Unlicensed use of copyrighted, trademarked, or protected works
• AI-generated deepfakes intended to mislead, impersonate, or defame individuals or brands

• Scripts or avatars promoting harmful ideologies, political extremism, or pseudoscience

Engaging in any of the above may lead to immediate suspension, content deletion, permanent account termination, and where appropriate, legal action.

5. Compliance with Applicable Laws

All users must comply with applicable UK, EU, US, and international laws, including those related to:

• Copyright and digital media
• Advertising and consumer protection
• Intellectual property rights
• Data privacy (e.g., GDPR, CCPA)
• AI transparency and platform regulations

MakeUGC operates in compliance with global content and AI governance standards. By using our Services, you affirm that your use of the platform will not violate any local laws applicable to you or your organization.

6. Content Licensing and Output Use

The outputs generated by MakeUGC’s AI tools are licensed to users only if they have a valid and active paid subscription. Free-tier users are not entitled to commercial rights or redistribution licenses. Content created through our Services must not be sold, sublicensed, or used in external platforms without the appropriate subscription level or licensing agreement in place.

‍

MakeUGC is not responsible for how users choose to deploy generated content. Users are strongly advised to conduct legal review, brand compliance, and platform checks before publishing.

7. AI Output Disclaimers

Due to the nature of generative AI, MakeUGC cannot guarantee the factual accuracy, uniqueness, or legal soundness of any output. You are responsible for reviewing all content prior to use. We discourage the use of AI-generated outputs as the sole basis for legal, medical, financial, or reputational claims.

‍

Misuse of AI outputs to impersonate real people, fabricate testimonials, or make deceptive claims is strictly forbidden and may be reported to relevant regulatory authorities.
